Peranan Mahasiswa Mengembalikan Keakraban Malaysia dan Indonesia.

"Jambatan bukan hanya dibina melalui konkrit, malah ia boleh terbentuk melalui interaksi kemanusiaan”, kenyataan ini menunjukkan betapa mustahaknya memupuk persefahaman antara sesama manusia. Kenyataan ini adalah ekoran situasi di mana kedutaan Malaysia di Jakarta, Indonesia, telah diserang oleh sekumpulan rakyat Indonesia. Malah, kumpulan ini turut membaling najis pada bendera Malaysia serta kawasan kedutaan besar Malaysia. Demonstrasi ini dipercayai didalangi oleh kumpulan yang tidak bertanggungjawab yang bermotif menimbulkan perasaan marah rakyat Malaysia.

Konfrontasi antara Indonesia dan Malaysia yang mana bermulanya pada 17 September 1963, di mana Malaysia memutuskan hubungan diplomatik dengan Indonesia. Konflik antara 1963 hingga 1966 memperlihatkan beberapa usaha ke arah menjernihkan kembali hubungan baik dua negara. Puncak kepada tamatnya konfrontasi ini ialah pada 3 Ogos 1966 apabila Suharto iaitu Presiden baru Indonesia, mengumumkan tamatnya dasar konfrontasi terhadap Malaysia dan perjanjian untuk memulihkan hubungan Malaysia dan Indonesia telahpun ditandatangani.

Kepimpinan berkarisma serta berwibawa Bung Karno dan Pak Harto selama ini dilihat sebagai pimpinan yang mengamalkan ciri- ciri konfrontasional. Namun pasca merdeka Republik Indonesia, proses pembinaan Indonesia menampakkan bagaimana ideologi PANCASILA mempengaruhi pembentukan bangsa Indonesia. Bagi Malaysia yang mana kemajuannya dicapai melalui acuan sendiri tanpa menggugat negara - negara serantau sehinggakan Malaysia kini dimartabatkan sebagai negara ke-37 terbaik di dunia dalam Senarai 100 Negara Terbaik yang diterbitkan oleh majalah Newsweek baru- baru ini. Acuan sejarah pembinaan bangsa dan negara masing- masing patut senantiasa dijadikan sebagai rujukan terutamanya dalam menangani konflik- konflik serantau supaya apa jua tindakan yang diambil tidak bertentangan dengan fitrah dan norma masyarakat tempatan.

Tiga hari sebelum Malaysia menyambut Hari Merdeka, Perdana Menteri Malaysia, Dato’ Seri Najib bin Tun Abdul Razak berkata, “kedua- dua Malaysia dan Indonesia mempunyai kepentingan bersama dan tidak seharusnya membiarkan perkara ini menjadi sesuatu yang boleh mengancam hubungan dua hala”. Sehari selepas Hari Merdeka Malaysia, pada 1hb September 2010 yang lalu Presiden Indonesia, Susilo Bambang menyatakan bahawa, Indonesia mempunyai hubungan sejarah, budaya dan kekerabatan yang sangat erat- dan mungkin yang paling erat dibanding negara- negara lain, dan sudah terjalin selama ratusan tahun. Dalam mengupas soal hubungan Indonesia-Malaysia, beliau turut berkata, “kita mempunyai tanggungjawab sejarah, iaitu untuk memelihara dan melanjutkan tali persaudaraan ini”. Kenyataan daripada kedua- dua pemimpin ini jelas memaparkan betapa pentingnya hubungan kerjasama serantau antara Indonesia dan Malaysia.

Mengambil kira banyak persamaan yang kita kongsikan bersama- sama Indonesia, hubungan kedua- dua negara itu sepatutnya sudah erat sejak dahulu. Kedua- dua Indonesia dan Malaysia dilihatkan sebagai sebuah keluarga besar yang berada dalam rumpun yang sama. Menurut bekas Perdana Menteri, Tun Dr. Mahathir, “kalau bahasa kita sama, seharusnya salah faham antara kita tidak sepatutnya berlaku”. Dalam banyak keadaan, hubungan keakraban kekeluargaan ini “dicemari” insiden- insiden yang kurang menyenangkan. Walaubagaimanapun, ia tidak patut diheboh- heboh dan diperbesarkan, bak kata pepatah, ayam yang bertelur sebiji, riuhnya hingga sekampung. Sebenarnya, konflik ataupun perselisihan yang berlaku boleh diibaratkan umpama si kakak memukul si adik. Pertelingkahan kecil- kecilan sememangnya bukan bersifat kebencian dan berdendaman, malah ia bertujuan mendidik. Ini mengimplikasikan bahawa pertelingkahan tidak akan berpanjangan dan sudah tentunya ia dapat diselesaikan secara harmoni melalui toleransi dan sikap keterbukaan kedua- dua negara jiran.

Barangkali, anasir- anasir jahat dan pelbagai hasutan yang dilontarkan oleh pihak yang tidak bertanggungjawab yang bermotif memporak- perandakan keluarga ini seolah- olah menyimbahkan minyak ke atas api yang sedang marak. Melihat kepada persoalan ini, penyelesaiannya bukannya dengan mencurahkan air sejuk mahupun minyak panas. Api yang sedang membara memerlukan kedua- dua pihak mengolah langkah seterusnya mengambil tindakan penyelesaian yang bersesuaian, inovatif dan praktikal supaya dapat menghalang api daripada merebak.

Dalam usaha menangani masalah- masalah bersifat bilateral, belia terutamanya golongan mahasiswa sebenarnya memainkan peranan yang amat penting. Kesepakatan mahasiswa mampu menjadi suara penyatuan khususnya melalui penglibatan dalam aktiviti- aktiviti seperti program pertukaran pelajar yang dikenali sebagai Students Exchange Program, program antarabangsa dan sebagainya. Persidangan Global Model United Nations (GMUN 2010) yang dianjurkan di Malaysia pada 16 Ogos 2010 yang lalu merupakan antara platform paling sesuai dalam memupuk perpaduan sejagat, dari sudut akar umbi ini. Para peserta berkesempatan mengembangkan perhubungan merentas budaya antarabangsa yang berpanjangan dengan para peserta lain. Penglibatan peserta- peserta dalam aktiviti sebegini rupa memberi satu saluran kepada para peserta untuk mencetuskan idea, pendapat dan penyelesaian alternatif kepada isu- isu global. Pendedahan para peserta khususnya belia yang juga mahasiswa kepada perbincangan topik- topik global seterusnya mencari jalan penyelesaian terhadap masalah yang dihadapi melatih kita supaya berpandangan jauh. Ia membuka lembaran kita untuk belajar berhadapan dan menerima pandangan yang berbeza- beza.

Persoalannya, adakah program berbentuk ini dapat memberi kesan membina dan yang mendalam terhadap masyarakat secara keseluruhannya padahal peserta yang berpeluang mengikuti program sebegini hanya terhad kepada berpuluh- puluhan orang. Dengan hanya bergantung kepada perlaksanaan program antarabangsa, sememangnya ia tidak memadai untuk menyumbangkan perubahan yang drastik. Ia memerlukan komitmen dan kesanggupan belia terutamanya golongan mahasiswa yang telah banyak bergiat aktif dalam aktiviti- aktivit bersifat antarabangsa untuk menerap masuk erti kesinambungan, keeratan, keakraban dan kesaudaraan ke dalam jiwa dan raga keluarga besar kita.

Di arena antarabangsa, persamaan dari segi perjuangan dan matlamat yang didukung oleh semua negara seperti keamanan sejagat dan perdagangan bebas lebih diberi keutamaan berbandingkan perbezaan dari segi ekonomi, sosial, budaya dan politik dari negara ke negara. Dalam usaha mencapai keamanan dan pembangunan sejagat, 192 negara yang menganggotai Persatuan Bangsa- Bangsa Bersatu ataupun lebih dikenali sebagai United Nations terpaksa menerapkan sikap keterbukaan supaya persefahaman antara rantau dan blok dapat dipertingkatkan. Sikap mementingkan diri wajar dikikis, bersikap keterbukaan tidak sesekali bermakna kita mengenepikan kepentingan negara kita. Secara tuntasnya, dalam memperjuangkan dan memartabatkan kepentingan negara masing- masing; kepentingan negara perlu diseimbangi dengan kepentingan sedunia. Ini merupakan antara nilai- nilai yang perlu kita semai dan terapkan dalam kalangan masyarakat kini.

Seandainya suara dan kekuatan mahasiswa Indonesia dapat tumbangkan kerajaannya pada tahun 1998, inilah hakikat kekuatan mahasiswa yang digelarkan Indonesia. Di Malaysia, walaupun mahasiswanya tidak begitu ‘agresif’ berbanding rakan- rakan di Indonesia, namun peranan berhemah dan berdaulat mahasiswa tidak boleh dilihat enteng. Mahasiswa hari ini mesti memainkan peranan masing- masing sebagai mekanisme untuk “menambatkan” hubungan keeratan dan kekeluargaan antara Malaysia dan Indonesia yang telahpun berakar sejak zaman nenek moyang kita. Inilah suara mahasiswa yang mampu membawa perubahan serta memberi keyakinan kepada dunia bahawa dunia pada hari ini masih cerah harapannya.

Usaha mengharmonikan lagi keluarga besar Indonesia dan Malaysia sudah tentu dapat memupuk kerjasama antara kedua- dua negara khususnya dalam bidang ICT, ekonomi dan lain- lain lagi. Sebagai negara- negara anggota ASEAN, kerjasama Malaysia dan Indonesia dalam membangunkan rantau ini tidak boleh dinampak goyah. Kita tidak boleh berdendam- dendaman walaupun dalam perkara remeh atas sebab ia tidak memberi manfaat melainkan kepada pihak ketiga yang ingin melihat kita berselisihan sesama sendiri. Tun Dr. Mahathir pernah berkata, “ada orang lain yang sedang menunggu peluang untuk melihat kita bergaduh kerana ini akan memberi keuntungan kepada mereka”. Pendek kata, kita tidak sanggup benarkan kuasa- kuasa barat ‘menerobosi’ permuafakatan kita seperti apa yang telah diperlakukan ke atas benua timur tengah dan Arab.

Perubahan ini bukan suatu yang mustahil, ia merupakan suatu cabaran yang mana semua rakyat baik Malaysia mahupun Indonesia mesti berganding bahu bagi mengembalikan keakraban dan keeratan hubungan persaudaraan dalam keluarga besar ini.

Seperti kata Mahatma Gandhi “You must be the change you wish to see in the world”. Justeru, perubahan itu perlu bagi manfaat bersama.

Mahasiswa berparti- politik? Biar mahasiswa yang tentukan…

Sejak pindaan Akta Universiti dan Kolej Universiti (AUKU) pada 1970-an di mana kerajaan terpaksa meletakkan batasan atau sempadan terhadap kebebasan mahasiswa untuk bergiat dalam parti politik, penglibatan mahasiswa dalam parti politik hangat dibicarakan baik dalam kalangan mahasiswa ataupun para akademia. 4hb Ogos yang lalu, kenyataan dan cadangan Datuk Saifuddin dalam Soal Jawab TV3 yang bersetuju bahawa mahasiswa wajar dibenarkan berparti politik merupakan satu idea yang cukup berani di mana mahasiswa diberi kepercayaan dan keyakinan sepenuhnya bahawa mereka mampu dan dapat berfikir secara matang serta mampu membezakan antara yang baik dengan yang buruk.

Bagi mahasiswa, sudah tentu kami berasa amat gembira dengan kepercayaan dan keyakinan yang diberi oleh YB Timbalan Menteri Pengajian Tinggi. Apa yang diperkatakan oleh beliau sememangnya benar sekali apabila menyatakan bahawa mengambil cakna perkembangan politik semasa merupakan proses yang akan membentuk dan melahirkan mahasiswa yang berpandangan jauh serta berfikiran matang. Namun, kami berpendapat bahawa melibatkan diri dalam parti politik secara langsung dan berdaftar sebagai ahli parti bukan satu- satunya cara untuk mengikuti perkembangan isu-isu politik. Persoalannya, adakah kebebasan untuk menyertai parti politik jauh lebih penting berbanding proses untuk melahirkan graduan yang boleh berfikir secara kritikal, berdaya saing, berpengetahuan luas, berketrampilan serta mempunyai kemahiran dalam bidang masing- masing??? Persoalan ini mesti dijawab dan dijustifikasi sebelum pihak kerajaan membuka ruang kepada mahasiswa untuk menyertai parti politik.

Berbalik kepada AUKU khususnya Seksyen 15 yang tidak membenarkan mahasiswa menyertai parti politik, kami amat tidak bersetuju dengan pandangan yang mengatakan bahawa peruntukan undang- undang ini membantutkan perkembangan mahasiswa. Terdapat juga hujah- hujah yang menyatakan mahasiswa tidak mampu terkehadapan selagi Seksyen 15 tidak dipinda. Sebenarnya, kita patut melihat dan mengupas isu ini daripada perspektif yang lebih menyeluruh. Menyertai parti politik bukan satu- satunya langkah untuk melahirkan mahasiswa minda kelas pertama. Banyak perkara lain yang jauh lebih penting perlu diberi perhatian. Dari sudut pandangan para aktivis, sudah tentu sesiapa sahaja boleh menjadi pemimpin. Selagi mandat diberi melalui pilihan raya, “postman” “penjual ikan” pun boleh menjadi wakil rakyat. Kini, kita bukan sekadar mahukan pemimpin yang boleh berhujah di khalayak ramai, tetapi juga mestilah mempunyai kredibiliti dan kelayakan untuk menerajui negara. Ini secara tidak langsung menjadi tunjang kepada pembangunan negara sekali gus mengharumkan nama negara kita di persada antarabangsa. Sewajarnya, mahasiswa yang bakal menjadi pucuk pimpinan negara mesti memberi keutamaan kepada pelajaran serta meningkatkan soft- skill masing- masing sewaktu berada di menara gading. 3 atau 4 tahun berada di institusi pengajian tinggi merupakan tempoh yang amat singkat, masa ini akan menjadi sia- sia sekiranya kita tidak menggunakannya secara berfaedah. Sekali lagi kami tegaskan, kami tidak menafikan kebebasan mahasiswa untuk berparti- politik. Akan tetapi, kami berpandangan bahawa 3 tahun berada di universiti wajar digunakan sebaik-baiknya untuk menguasai ilmu pengetahuan dalam bidang masing- masing dan meningkatkan soft- skill melalui penglibatan dalam program- program yang bersifat ilmiah, kebudayaan, kepimpinan, riadah dan lain-lain lagi.

Kami tidak menolak bahawa mahasiswa tidak boleh bergiat dalam parti politik selama-lamanya, tetapi kami merasakan bahawa belum sampai masanya lagi untuk membuka ruang kepada mahasiswa untuk menyertai parti politik. Pandangan ini bukan tidak berasas, berbagai- bagai aspek perlu diberi perhatian. Pelbagai persoalan perlu dijawab terlebih dahulu. Sudah tentu ada baik dan buruknya. Menurut Tan Sri Ibrahim Abu Shah,“Kita patut melihat samada perkara ini membuahkan kesan positif yang lebih banyak ataupun kesan yang sebaliknya”.

Kini, sebahagian besar masyarakat kita telah hilang keyakinan terhadap parti- parti politik di Malaysia samada Barisan Nasional mahupun Pakatan Rakyat. Faktornya bukan disebabkan kerajaan tidak berusaha atau tidak mengambil inisiatif untuk mengembalikan situasi politik yang lebih stabil, tetapi masyarakat sendiri mempunyai persepsi yang amat negatif terhadap scenario politik di negara kita. Walaubagaimanapun, rakyat tidak patut dipersalahkan sama sekali dek kerana mainan politik yang melampau-lampau sehinggakan masyarakat meragui keikhlasan ahli- ahli politik dalam memperjuangkan kesejahteraan dan pembangunan negara. Keraguan dan kesangsian masyarakat inilah yang mendorong kepada hilangnya keyakinan terhadap ahli- ahli politik serta parti politik di negara kita amnya. Keyakinan rakyat terhadap pimpinan negara adalah amat penting dalam pembangunan negara bagi merealisasikan impian Malaysia untuk menjadi sebuah negara maju serta berpendapatan tinggi menjelang tahun 2020 seperti yang dibentangkan oleh YAB Perdana Menteri Dato’ Sri Najib dalam Rancangan Malaysia ke-10 (RMK10). Masalah ini juga menjurus kepada segelintir rakyat yang tidak yakin dengan negara sendiri sehinggakan sanggup menetap di negara lain seperti Australia, Canada, Singapura, US dan sebagainya. Inilah menjadi faktor “Brain- drain” di mana negara kita kehilangan sumber manusia ‘Human Capital’. Negara kita kaya dengan sumber asli, tetapi oleh kerana ‘kehausan’ dan ‘ketandusan’ sumber manusia menyebabkan kita masih jauh tertinggal di belakang Singapura. Maka, kita perlu bijak membezakan apakah sebenarnya yang lebih utama buat pembangunan negara sama ada kebebasan mahasiswa untuk berpolitik atau pembentukan mahasiswa minda kelas pertama???

Suasana politik di negara kita tidak memerlukan pimpinan yang terlalu radikal dan taksub dengan ideologi politik tersendiri bagi memperjuangkan pembangunan rakyat dan negara. Kami berpendapat bahawa suara mahasiswa masih ada ruang dan diberi perhatian oleh pelbagai lapisan masyarakat sekiranya mahasiswa itu bebas berfikir, bebas membuat keputusan dan bebas mengkritik tanpa dipengaruhi oleh ideologi politik. Selama ini, kami tidak teragak- agak untuk menyuarakan sebarang ketidakpuashatian kepada mana- mana pihak kerajaan kerana kami adalah bebas dari kongkongan mana- mana parti politik. Atas dasar inilah yang memberi keyakinan kepada masyarakat bahawa mahasiswa- mahasiswi mampu berfikir secara matang dan rasional dalam membuat sebarang keputusan sekali gus mampu memacu negara kita selaras dengan cita-cita murni rakyat Malaysia merealisasikan wawasan 2020.

Dalam hal ini, mahasiswa yang tidak menyertai parti politik sebenarnya memainkan peranan yang amat besar untuk pembangunan negara. Realitinya, kami tidak mampu menyediakan infrastukstur yang berbillion- billion kepada masyarakat; namun kami mampu menyumbang dari segi modal insan serta pemikiran yang terbuka untuk membantu kerajaan membangunkan negara. Kalaulah masyarakat hari ini tidak menerima konsep 1 Malaysia hanya kerana idea ini dibawa oleh Barisan Nasional, namun begitu biarlah mahasiswa yang membawa konsep 1 Malaysia ke kampung- kampung, biarlah mahasiswa yang bebas memupuk perpaduan dalam kalangan masyarakat Melayu, Cina dan India, biarlah mahasiswa yang bebas mempromosikan toleransi antara kaum, biarlah mahasiswa yang bebas menyakinkan rakyat bahawa negara kita boleh terkehadapan dan biarlah mahasiswa merealisasikan Wawasan 2020. Mahasiswa boleh melaksanakan kesemua ini selagi kami tidak membawa ideologi parti politik masing- masing.

Seperti yang diperkatakan oleh YB Timbalan Menteri, mahasiswa zaman sekarang mampu berfikiran secara matang dan boleh membuat pertimbangan yang tersendiri, maka pihak kerajaan perlu yakin bahawa kami telah berfikir secara matang dan membuat pertimbangan secara rasional bahawa belum sampai masanya lagi untuk membuka ruang kepada kami untuk menyertai parti politik sewaktu kami masih menuntut di menara gading. Saya mengharapkan supaya pihak kerajaan mengekalkan ‘status-quo’ dan tidak terburu-buru membuat keputusan untuk membawa suatu perubahan yang bakal mendatangkan pelbagai impak negatif kepada masyarakat dan negara.

Saudara- saudari,

Salam dan selamat sejahtera. Berkenaan insiden di mana 4 pelajar UKM yang bakal didakwa di bawah Seksyen 15(5)(a) yang akan dibicarakan pada 3 Jun di Universiti Kebangsaan Malaysia atas perbuatan menyatakan "sokongan" kepada Parti Politik Pembangkang- Pakatan Rakyat melalui edaran CD semasa minggu berkempen Pilihanraya Kecil Hulu Selangor, banyak antara kita termasuklah ibu- bapa yang telah lama meniggalkan menara gading bertanyakan APAKAH "GANJARAN" BAKAL DITERIMA SEKIRANYA MEREKA DISABITKAN BERSALAH DI BAWAH TUDUHAN S.15(5)(a) AUKU 1971.

Terlebih dahulu, izinkan saya kongsikan apakah sebenarnya yang diperuntukkan di bawah Seksyen 15(5)(a) AUKU 1971:

Tiada seorang pun pelajar Universiti dan tiada pertubuhan, badan atau kumpulan pelajar Universiti yang ditubuhkan oleh, di bawah atau mengikut Perlembagaan, boleh menyatakan atau melakukan apa- apa jua yang boleh semunasabahnya ditafsirkan sebagai menyatakan sokongan kepada atau simpati dengan atau bangkangan terhadap mana- mana parti politik, sama ada di dalam atau di luar Malaysia.

Ulasan saya akan dibahagikan kepada 3 bahagian utama di mana:

1) Tafsiran perkataan "PELAJAR" dalam peruntukan S.15(5)(a)
2) Syarat Utama"...semunasabahnya ditafsirkan...menyatakan sokongan"
3) Implikasi undang- undang.

1) Tafsiran perkataan "PELAJAR" dalam peruntukan S.15(5)(a)

1.1) PELAJAR
Menurut Seksyen 2(d) AUKU(Pindaan) 2009, "pelajar" ertinya seseorang pelajar berdaftar, selain pelajar di suatu institusi yang bersekutu dengan Universiti atau Kolej Universiti, yang mengikuti kursus pengajian, pengajaran, latihan atau penyelidikan daripada apa- apa perihalan pada peringkat persediaan, praijazah, lepas ijazah atau lepas kedoktoran secara sepenuh masa atau sambilan dalam, oleh atau dari Universiti atau Kolej Universiti itu, dan termasuklah pembelajaran jarak jauh, luar kampus, pertukaran dan pelajar tidak berijazah.

Di sini, saya merasakan tiada perlunya saya mengurai secara "in detail" dalam situasi kita sebab kita sedia maklum bahawa keempat- empat masiswa ini merupakan pelajar pra-siswazah di Fakulti Sains Sosial dan Kemanusian dalam bidang Sains Politik.

2) Syarat Utama- "...semunasabahnya ditafsirkan...menyatakan sokongan"

2.1) DI sini, apa yang diperuntukkan hanya "munasabah". Persoalannya, keputusan bagaimanakah yang boleh dikira sebagai munasabah.

Untuk tujuan ini, suka saya petik penerangan "munasabah/ reasonableness" daripada Lord Greene dalam kes ASSOCIATED PICTURE HOUSES LTD V WEDNESBURY CORP [1948] di mana beliau mengatakan:

"... the test of unreasonableness is not what the courts think is reasonable, but 'unreasonable' here is 'something so absurd that no reasonable or sensible person could have come to that decision'..."

Dalam konteks perundangan Malaysia, prinsip digariskan dalam kes WEDNESBURY telah diterimapakai. Dalam kes ORIENTAL INSURANCE CO LTD V MINISTER OF FINANCE [1992], Mahkamah Tinggi dalam penghakimannya:

"...quashed the Minister's order as being 'irrational being so outrageous in its defiance of logic and/ or accepted moral standards that the consequence was manifest injustice caused to someone who was completely innocent of any wrong doing'..."

Dalam kes HARPENS TRADING (M) S/B V NATIONAL UNION OF COMMERCIAL WORKERS [1991], Mahkamah Agung:

"...we reject the contention that the decision of the Industrial Court is so manifstly unreasonable that no body of persons could have reached it..."

Persoalannya jelas mengenai samada perbuatan "mengedar CD" bagi pihak parti politik menjurus kepada perbuatan yang boleh semunasabahnya ditafsirkan sebagai menyatakan sokongan kepada parti politik tersebut. Dengan mengaplikasikan ujian- ujian yang telah diputuskan dalam beberapa kes utama oleh mahkamah Malaysia, bagi seseorang yang mampu berfikiran secara waras dan munasabah perbuatan mengedar CD oleh remaja(mahasiswa universiti) yang berusia lebih daripada 21 tahun bagi pihak parti politik tidak kiralah mana- mana parti politik; ia adalah memadai dan rasional untuk mengatakan bahawa "pengedar" ini menyata sokongan terhadap pihak tertentu.

Saudara- saudari, sebenarnya perbuatan mengedar CD bagi pihak parti politik Pakatan Rakyat ini adalah cukup "simple" untuk kita nilai samada ia bersifat menyatakan sokongan kepada pihak parti politik tertentu. Cuba anda nilaikan perbuatan ini secara rasional, tenang dan tidak beremosi; sudah pasti anda bersetuju dengan pendapat saya.

3) Implikasi Undang- undang

DI bawah Seksyen 15(7) AUKU (Pindaan) 2009, mana- mana pelajar Universiti yang melanggar subseksyen (1) atau (5) boleh dikenakan tindakan tatatertib.

Selain S.15(7), perhatian juga perlu diberikan kepada Seksyen 15B di mana jika suatu kesalahan boleh daftar telah dilakukan di bawah mana- mana undang- undang bertulis dan kesalahan itu telah dilakukan atau berupa sebagai telah dilakukan atas nama atau bagi pihak mana- mana pertubuhan, badan atau kumpulan pelajar Universiti yang ditubuhkan oleh, di bawah atau mengikut Perlembagaan, tiap- tiap orang yang disabitkan atas kesalahan itu boleh dikenakan tindakan tatatertib dan pertubuhan, badan atau kumpulan pelajar itu hendaklah diuruskan mengikut seksyen 16.

Seksyen 15D(1)(a) dan (b): Jika sseorang pelajar Universiti dipertuduh atas suatu kesalahan boleh daftar dia boleh, mengikut budi bicara Naib Canselor, DIGANTUNG DARIPADA MENJADI SEORANG PELAJAR dan Jika seseorang pelajar Universiti yang dipertuduh atas suatu kesalahan boleh daftar di bawah subseksyen (1) disabitkan atas kesalahan itu, pelajar itu boleh dikenakan tindakan tatatertib.

SEKIRANYA 4 MAHASISWA DSABITKAN KESALAHAN, ini tidak bermakna masa depan untuk mereka terus menuntut di Universiti telah tamat kerana Seksyen 15D(6) membenarkan mereka dimasukkan balik ke Universiti dengan syarat mendapat kelulusan daripada Menteri dalam masa empat belas hari dari tarikh penerimaan notis penggantungan atau pembubaran itu, merayu secara betulis kepada Menteri dan ini adalah berlandaskan Seksyen 16(2).

Di bawah Seksyen 16C(2), Kaedah- kaedah tatatertib yang dibuat di bawah seksyen ini boleh termasuk peruntukan bagi penggantungan seseorang pelajar Unversiti semasa prosiding tatatertib belum selesai.

* Provisi ini memberi bidangkuasa kepada Lembaga Tatatertib untuk menggantung pengajian 4 mahasiswa yang didakwa di bawah S.15(5)(a) walaupun prosiding belum tamat dan selesai.

Di bawah Seksyen 16C(3), Kaedah- kaedah tatatertib yang dibuat di bawah seksyen ini hendaklah mewujudkan apa- apa kesalahan tatatertib dan mengadakan peruntukan bagi apa- apa hukuman tatatertib yang difikirkan sesuai oleh Lembaga, dan hukuman yang diperuntukkan sedemikian boleh meliputi PEMBUANGAN PELAJAR daripada Universiti.

Petikan ini bertujuan memberi satu gambaran berkenaan peruntukan- peruntukan di bawah Akta Universiti Kolej Universiti 1971 mengenai kesalahan yang dituduh di bawah S.15 dan tidak berniat untuk membuat satu penghakiman/ keputusan lebih awal sebelum perbicaraan selesai.

Adakah "mohon maaf" susah sangat nak dilafazkan???

Ekoran Aminulrasyid Amzah - pelajar 14 tahun yang ditembak polis pada hujung bulan lalu, keluarganya telah menuntut supaya sekurang- kurangnya pihak polis dan kerajaan meminta maaf dan seterusnya membersihkan nama budak 14 tahun daripada dilabelkan "penjenayah".

Namun, pihak polis enggan berbuat demikian. Ditanya kenapa pihak PDRM enggan mminta maaf daripada keluarga Aminulrasyid, Tan Sri Hassan Musa (IGP/ KPS) bertindak untuk tidak mengulas topik ini. Katanya, ia mempunyai implikasi undang- undang.

Suka saya ditanya di sini, apakah "implikasi undang- undang" yang dimaksudkan si Tan Sri Musa???

Bagi saya, pihak PDRM patut memohon maaf daripada keluarga Aminulrasyid. Ini adalah kerana situasi dan keadaan kes A.rasyid memerlukan pihak polis supaya membuat demikian demi "membetulkan" persepsi orang ramai terhadap kewibawaan pihak polis negara Malaysia.

Kini, institusi PDRM merupakan antara institusi- institusi yang paling "disukai dan diminati" rakyat Malaysia. Kenapakah??? Pernahkah pihak polis memandang serius perkara ini??? Saya percaya seluruh badan PDRM sedar akan "pencapaian" ini. Tiada alasan bagi Tan Sri Musa Hassan untuk kata beliau tidak mengetahui.

Walaubagaimanapun, sudah sampainya masa pihak kerajaan khususnya Kementerian Dalam Negeri di bawah pimpinan DS Hishammudin dan juga pihak PDRM membuat sesuatu supaya nama pihak polis Malaysia dapat diperbersih seterusnya mendapat balik keyakinan dan kepercayaan rakyat terhadap pihak polis.

Memang benar pegawai yang tembak A.rasyid bukan Tan Sri Musa, namun beliau patut mengambil langkah, memberanikan diri dan berdepan dengan rakyat supaya satu respon yang memuaskan dapat diberi kepada rakyat.

Percayalah, seluruh rakyat Malaysia tahu dan sedar serta amat memahami apa yang sedang berlaku di negara kita. Insitusi polis, kehakiman dan sebagainya merupakan badan "kontroversi" yang selalu dijadikan isu/ bahan serang oleh pihak pembangkang terutamanya dalam pilihan raya.

Ada kawan- kawan yang memberitahu, kemenagan (majoriti tipis) yang diraih oleh kerajaan Barisan Nasional dalam pilihan raya kecil Hulu Selangor sebenarnya membuktikan kerajaan Barisan Nasional masih gagal mendapat balik sokongan, keyakinan dan kepercayaan rakyat.

DS Najib perlu sedar bahawa Pilihan raya merupakan satu platform di mana ia mencerminkan kepuasan rakyat terhadap pentadibiran negara kita. Dalam pada ini, institusi polis dan kehakiman memainkan peranan yang amat penting. Kini, rakyat mempersoalkan sejauh manakah badan kehakiman Malaysia independen; rakyat meragui ketelusan, kewibawaan pihak polis; rakyat bimbang hak- hak mereka dicabuli; rakyat menafikan barisan kerajaan yang gagal mempertahankan dan menjaga hak serta keselamatan mereka.

Pendek kata, tidak kiralah apa implikasi undang- undang yang dimaksudkan oleh Tan Sri Musa Hassan; rakyat tidak pedulikan. Apa yang rakyat mahu ialah keikhlasan pihak polis dalam menangani kemelut ini. Adakah semua rakyat meminta Tan SRi Musa letak jawatan? Adakah rakyat menuntut Tan Sri Hassan dibalas tembakan??? Tidak sama sekali.... Saya percaya, kebanyakan kita yang mampu berfikiran rasional; kita mahukan pihak polis sekurang- kurangnya memohon maaf terhadap ibu Aminulrasyid.

Tidak kiralah apa- apa agama, khususnya Islam mempertahankan nyawa dan keluarga umatnya. Nyawa dan keluarga merupakan antara lima rukun yang wajib dipertahankan umat- umat Islam selain Agama, Intelektual dan Harta.

Maka, saya menyeru rakan- rakan sekalian tidak kira bangsa dan jantina; sama- sama kita "menggalak/ mendesak" supaya Tan Sri Hassan memohon maaf kepada sekurang- kurangnya ibu Aminulrasyid...

KELANTAN OIL "ROYALTY" CLAIM, what does the law say???

Dear friends,

It came across my mind so suddenlyto write something on Oil Royalty claim by the state of Kelantan which is a "sexy" and hot issue playing in the socity nowadays.

I believe all of us are well aware about the existence of Petroleum Development Act 1974 (hereinafter referred as PDA).

Under PDA, all states inclusive of the state of Kelantan carry the same status. All states which have duly put down their signatures in entering agreement with PETRONAS around the year of 1975 or 1976 would get paid of cash amounting to 5% from the value of the petroleum discovered in the respectful states.

Ladies & gentlemen,

1) In fact, we must take note that "Royalty" is not seen in the entire PDA. What was stated in the PDA is clear enough to refer the 5% payment from the revenue of the oil and gas as "cash payment" (Bayaran Tunai). I'd re-emphasize the wording of "Royalty" is not being used in the PDA.

2) Now comes the interesting topic, what qualifies the state government to be afforded 5% cash payment???

In accordance with the agreement entered into force between PETRONAS and state government in 1975/ 1976, the oil-rich discovery must be within 3 nautical miles (5.6KM) of the territorial sea from the mainland of the state.

3) In the event Kelantan state governmnt files a claim of "royalty", is it admissible?

Relating to admissibility of the claim, I'd now address whether Kelantan or other state governments are justified to claim the aforesaid "royalty". I respond Kelantan state or any of other states in Peninsular Malaysia has no standing to claim any single cent after having taken into account all of the oil blocks which operates and produces in Peninsular for time being are located beyond the restricted 3 nautical miles (5.6KM) of the territorial sea. Therefore, these disputing states especially Kelate couldn't request for Oil Royalty unless and until the House amends the Petroleum Development Act 1974.

4) PLease dont make comparison with Sabah and Sarawak ok...

Prior to 1974, before the Petroleum Development Act is legislated, the existing Sabah and Sarawak upon that time have been accorded right towards Oil Royalty claim which such right was justified under the COntinental Shelf Act 1966. And this right is recognised as part of their "hak istimewa" upon joining Peninsular which then formed Malaysia in 1963.

I'm not saying Kelantan has no right at all la, what i want to convey is the problem/ hindrance with the claim of Oil Royalty is with our current Petroleum Development Act 1974.

Pendek kate, should the state governments want to claim the oil royalty; PDA 1974 must be amended lo...

Why private Law institutions students should go against Common Bar Exam???

My dear friends,

Before this, I was writing on opposing Common Bar Exam (hereinafter referred as CBE). My fellow friends said that I was too bias towards the Local Universities students. I responded disagreement but I was very busy with exam so couldnt put my thoughts together.

Now, I'm briefing u on why not only Public Universities Law students but also Private Law Institutions students should oppose CBE.

By all means, being a law student; we cant blindly oppose it. Whatever disagreement must be justified.

If u can recall, the idea of abolishing the existing Certified Legal Practice (hereinafter referred as CLP) system and replace it with CBE is due to the fact that CLP has sort of 'out- dated' and it does not fit in the niche in the 21st century legal industry especially if it were to narrow down to the context of Malaysia.

Factors on this issue have been duly addressed in my previous Note.

This Note is to focus on the consequential part. The question which evryone of us would ask how is this CBE going to affect us? Is it any implications? By all means there are implications, the following question would be are these implicatons positive or otherwise?

On the 1st meeting with Ragunath, President of the Bar COuncil Malaysia; I was briefed that the imposition and offer or CBE are restricted to four local universities namely UKM, UM, IIUM and UiTM. In other words, the existing law schools other than the abovementioned could not run CBE in their respective Law Schools. Hence. in the event this CBE were to be imposed, all students (to be specific the private law students) would need to study their CBE in the local universities (UKM, UM, IIUM, UiTM). This will consequent to those who intend to pursue their Bar Vocational COurse in UK (Lincoln's Inn, Middle Temple, Gray's Inn etc.) could never have their dreams fulfilled and realised on account of the only chanel to practise Law in Malaysia is by way of undergoing CBE in local Universities.

I have a question, how many of them who have obtained their LLBs in UK/ Aussie would like to come back Malaysia to sit for the CBE??? * As these group of people might doubt the quality of local law schools as compared to those INNs in UK.

Besides, it is reasonably enough to foresee that problems will arise again. Those law schools which confer degrees (LLB) would want their law schools to run CBE. For sure, there wouldnt be issues in the very first stage of implementation as those existing law institutions might not qualify to run CBE. Having it being considered in a long run, in the event these law schools are qualified to confer CBE in future; is Malaysian Qualification Agency (MQA) going to grant them the permission to run CBE in their respective law schools??? If so, Bar COuncil would stand before the younger generations start complaining about the CBE due to its quality and so on.

Furtherance, there are problems such as who is going to sit in the CBE panel; who set the exam questions for CBE; on what standard they admit the students and so on. These re jut a few matters, there're thousands of maters which we (all of us) need to ponder about.

To abolish a system which have been imposed decades ago and to replace it with a new-fresh policy, it is never as easy as we thought.

Putting myself in the shoes of private law institutions students, I'd urge the Bar COuncil/ MQA to review the existing CLP and in the event we are lacked of something; I believe all the 4 established Local universities are willing and much obliged to assist our friends in private law institutitons to sort out this matter.

My dear friends, living in 21st century; having ourselves moving into the era of globalisation; competetiveness is inevitable. Now, the only way we could fight for the betterment of the community is by way of cooperation and tolerance among each other. What I want to deliver is that there's no difference between U (private) and I (governemt), we must work together not on emotional basis but for the future of our legal pactice in our nation, Malaysia.

Though we oppose CBE, it does not mean we end right there. The spirit of helping the needs is still burning.....

Say NO to Common Bar Exam

My dear friends,

Common Bar Exam (hereinafter referred as CBE) is 'to be' imposed.

How much do u know about CBE?

Why some people are so concern about CBE???

This is due to the fact that this CBE will replace the current Certified Legal Practice (exam) which is currently only restricted to those who pursue their LLB in private institutions. The rationale why CLP is not invoked on public universities students is that pursuing LLB in public uni requires 4 years to complete but only 3 years in private. This additional 1 year in Public uni we learn professional subjects like Criminal & Civil Procedure Code, Ethic and etc.

In Malaysia, we have only around 15 law schools inclusive of Public uni and private colleges. The reason of requiring the graduates from private colleges to undergo CLP is to equip them with Malaysian Legal knowledge on account of they learn nothing about Malaysian Law along their 3 years LLB.

For Local Uni, we are learning Malaysian Legal System, we don't answer common law in exam for most of the subjects coz we are taught with Malaysian Law, we apply Malaysian cases. 4 years of exposure to Malaysian Law is far more enough than 1 year of CLP.

As far as we concern, there's no problem with CLP until this was raised by private institution in the year of 2000 and further proposed by Dato' Ambiga in 2006 who was the President of Bar Council at that juncture. The fact is that to pass CLP, it is undeniable not easy and due to that they have no choice but to spend a few hundred thousands to pursue their Bar at overseas (Lincolns Inn / Middle Temple/ Inner Temple etc.) in order to allow them to become legitimate lawyers.

Sudah tentu, there's no problem for those who are Kaya. How about for those who can't really afford; what to do??? Oppose CLP and propose a uniform exam for all regardless where he/ she studies.

For me, they are being too selfish! Why?

1st: to pursue law in private institution is not hard at all as compared to public uni provided u Kaya!

2: they don't require u to have 10As or 3.6 above to pursue LLB, 4 credits dalam SPM cukup laa; Again Janji Ada Duit!!!

3. Private institutions are not selective when it comes to admission coz the best candidates are admitted to public uni.

4. They can't afford to choose sebab kalau nak pilih, semua x layak; kalo x terima sape nak bayar gaji pensyarah & kerani itu pasal they select everyone Janji Ada Duit???

5. Private institutions graduates can't put at par with us because everyone knows to pursue Law in local universities u must be really GOOD; not only academic wise but also your curriculum.

6. We don't need CBE to produce capable & eligible lawyers as 4 years LLB in public uni are more than sufficient for us to know and faham Malaysian Law as compared to CLP which u learn Malaysian Law not even 1 year.

From this, it is clear cut that the problem is with Private institutions and has nothing to do with UKM, UM, UIAM, UiTM, UUM, UDM, USIM *correct me kalau ade yang tertinggal. This is not about 'tolerance', this isn't about Right To Be Heard.

I give u an analogy, when u know someone steals your handphone *Blackberry (hahaha. Sajer...) and he then asked u to give it to him, are u going to compromise and give away ur thousands of ringgit to him just because of he tells u he can't afford Blackberry??? Can he claimed he has right to express? Please la. Fuck off (sorry, m abit harsh) Don't deprive our right and further claim u r upholding your right 'so called equality'.

Halo, when I have nothing to with this problem, don't come and pull me in this trouble; this is your trouble in your colleges ok! Damn!!! Friends, I would only agree to have CBE provided Private institution practice our system of admission meaning to say, only pick the best! Not only that, they teach Malaysian law for four years, just like what we practise! If u think u r learning foreign law is so good, by all means don't kacau us!!! We say NO to Common Bar Exam.

I was taken aback when I was given to know that our churches are being torched. I have no idea why those people wanted to do so. I don’t think this is the best way of showing our feeling. Church is considered as ‘rumah ibadat’. Even Prophet Mohammad did not attack the ‘Rumah Ibadat’ when war was taken place. Any experts can tell me from which part of Quran/ SUnnah/ Hadith which permits the attack towards churches???

This posting is meant to share my personal understanding about Islam. Though I’m not a muslim, I think there’s no prohibition for me to understand the teaching of Islam.

The so called Holy Book in Islam namely the Quran lays down the principles that help Muslims achieve salvation, become better individuals and useful members of society. Muslims believe the Quran originated with God and Muhammad was the man chosen to deliver it. The Quran is organized in 114 chapters. Compiled 14 centuries ago, its original text has been preserved without any changes. It recognizes the Jewish and Christian faiths and teaches respect for the followers of these sister religions. The Quran recognizes the truth contained in the doctrines of Judaism and Christianity, and it confirms Abraham, Moses, Jesus and others as true prophets who preceded Muhammad.

Muslims grow up reading the stories of the biblical prophets Noah, Abraham, Moses, Isaac, Jacob, Joseph, Jesus and others in the Quran. The Quran is not anti-Christian or anti-Jewish, and it teaches tolerance and is explicit in directing its followers to respect all other faiths. The birth of Jesus to a virgin mother is narrated in the Quran and is a part of the Islamic belief. Mary is the only woman mentioned by name in the Quran. "Oh Mary ... God has chosen you above all the women in the world" (Quran 3:42).

The Quran regulates every phase of the life of a Muslim in religious practice, culture and morals. It contains directions for the leaders as well as for the common man, for the rich and the poor, for war and peace and for spiritual as well as the temporal. It speaks of the rules relating to social life, commerce, inheritance, marriage and penal law. It lays down the principles for the tenets of Islam. Through the Quran, Islam teaches moderation, tolerance, love for fellow humans, justice, fairness, compassion, spirit of sharing and respect for all faiths. Demanding equal rights for all, regardless of race, gender, ethnicity, social status or religion, it teaches respect for all faiths. It harkens its followers to be useful citizens and to answer the call of conscience.

I got a chance to speak personally with an Islamic expert during a forum some months ago, he is a Professor from one of the universities in Pakistan and he told me that Muslims recite Quran during the five daily prayers. Some Muslims understand it and apply its message in their daily living. Moved by its verses, most people are enthralled to hear and recite it as the Holy Book, but fail to apply its message in their daily lives. Many who read it don't understand its meanings or follow its spirit in their daily practice. Some have relegated it to reverence and respect and are content listening to it in weddings, funerals, birthdays and ceremonies. Some principles are explained while some are interpreted in separate bodies of writings. Many interpretations are complementary to the peaceful and noble teachings of the Quran, but some are not. Subject to interpretation and difference of opinion, some teachings have been taken out of context or literally and have been exploited as a pretext to foment extremism, fanaticism, violence or discord. I believe Islam will be seen as so ‘negative’ when Islam is misused.

"The Messenger will say: Oh my Lord! Truly my people have taken this Quran for just foolish nonsense" (Quran 25:30).

I wish all of us regardless of religions and races, please respect others' religion...

STUDENT INVOLVEMENT IN UNIVERSITY MANAGEMENT

In Malaysia, we have Universities & College Universities Act (1971), it is a piece of legislation which governs the establishment, maintenance and administration of our universities. By virtue of Section 15 & 16, it never infringes the students’ right of participating in the management. Notwithstanding the nice piece of legislation, the main concern and inclination of the universities are more to the enhancement of the study quality and facilities in the campus. The role and contribution of students to the governance of university departments is a relatively neglected area of inquiry. In Malaysia, student leaders experience a complex motivations and conceptions of the representative role and were particularly sensitive to the perceptions and expectations of academic staff. Role ambiguity was the greatest challenge reported by student representatives, and the overall effectiveness of the role was perceived to be reliant on the willingness and ability of academic managers and staff to engage in constructive dialogue with students. Indeed, the universities managers tend to perceive that their decisions are always the best for the students. By all means, none of any universities will implement or impose a system which is harmful to the students. Nonetheless, what we matter is the effectiveness of the implementation of such system. In determining whether a system works or in contrary, the crucial part is whether such imposition brings a positive impact to the students. It might sounds so “perfect” theoretically, but in practical it does not work. Therefore, it is very important to have an amicable solution and it is argued that universities need to adopt a more proactive approach to the development and support of students. Apart from that, the university should listen to the students’ voice. “Listen”, in the sense that not only a mere discussion with the students but to study thoroughly the issues of which being raised by the students.

English should be a "must pass" subject...

As to Tan Sri Muhyiddin's statement on whether English should be a "must pass" subject, I shall fully support on which statement.

The ministry's decision would definitely be very crucial to determine the future of Malaysia education system. Should this policy does implement by the Ministry Of Education, I do believe that this would probably benefit Malaysia and its Malaysians.

This simply denotes Malaysians are heading towards Vision 2020. Basically, we get the responses of which most people seem to be objecting this policy as they did to PPSMI. For the people who oppose this coming-up policy and the PPSMI, they should not be narow minded in which they have neglected the importance of English in fighting for national language. This shouldn't be. For God sake, they could only be the Hero in our country but never the one who can speak up in the international forums Or conferences. Why? People around the world have yet understood and spoken bahasa Malaysia widely, so as to convey Or deliver some msg from our country, by all means, Malay could not.

Futherance, the opposition never brings some examples of those 1st countries of which Korea, Japan where they use their own national languages in their government system this is due to we have yet reached the level of where people from the world have to learn and obtain something from us such as our technologies, knowledges and so on. Our atmosphere is unlike Japan and Korea. I do not mean we have to use English forever but we have to understand and wake up from the dream. We shall first utilise English by mastering it as to compete with others. We adopt the technologies, the knowledges and we further transform it! This is what Japan- Toyota did. Toyota was not the first automaker in the world but Benz did. Should we observe the reality, Toyota is ahead of Mercedes Benz. Adopt and transform, this is the principle we have to follow and obbey! Malaysia can be ahead of others if we work hard!

In course of this, they(opposition) virtully oppose thes policies (PPSMI and coming up English-"must pass" subject) is tinged with they worry of the rural areas students as they couldn't catch up the English. If so, when are thet going to catch up??? I they think this policy is cruel, what can further let them to improve their English???

Hence, do think and consider in a mature way before oppose something which really benefits the nations and could lights up the future of Malaysia.

They should not forsake English. Foresee the future and lets implement it!

Bankruptcy...Insolvency... What's that???

I was approached by a Client wherein whose case is about Insolvency & Bankruptcy matters. I further did some research on bankruptcy Act and spoke to the Insolvency Department Officer.

Basically, Insolvency is differ from Bankruptcy. An act to refuse to pay Or unable to pay the debt of the Creditor is said to be insolvent, and this might constitutes to Bankruptcy. A person is said to be Bankrupt only when he Or she is declared Bankruptcy by the Court through an Order. This Order is due when The said Creditor files an petition to Court. However, there are so called "Rules & Regulations" where the Petitioner needs to obey & follow and these said Rules are governed under Bankruptcy Act 1967.

The petition shall come effect commencing the Grant of the Order of Bankruptcy. This Order might sounds "Protective" To the Debtor as No creditors to whom the Debtor indebted in respect of any debt shall commence any action Or legal proceedings against the Debtor. However, the weather isn't stay nice & windy for the whole day, it always come with rain. Similarly, the "Protected" Debtor would probably loses all his rights on his property's affair. Every single of his assets com into the hand of the Director General of Insolvency. And these assets shall further become divisible among his creditors.

Dudes, never think of "Running" away from this "Protect". Never think of imigrating to other countries as u might think that probably will free yourself from all liabilities. Why? This is simple because the Court can at any time detain u and the Court can commit u to Prison unless u give a security where u promise not to leave the country.

However, we have to remember that the above mentioned situations are due to personal bankruptcy. There is also the other type of bankruptcy where it will sense more "protective" to the Bankrupt. This happens when a receiving order is made against a firm in the firm's name the Court shall not adjudge any person bankrupt as a member of the firm unless such person is proved to the satisfaction of the court to be a partner by his own admission or by evidence of oath.

2day, i'm approached by an old lady where we act as her Solicitors to take charge of a matter of which Probate matter. Basically, we need to file a petition to High Court to get a so called Grant Of Probate before the lady could legally execute her husband's (deceased) property. So, I had a conversation with the lady for almost 40 minutes, I was not surprised when she asked us how long should this take about as she handed the similar case to her previous lawyer and the lawyer drag about 2 years. By all means, she was quite angry & unsatisfied with our Court System.

Generally, people are not sure what is the "Court" and to what extend The Court has its power. Additionally, people do think that Court is the place where Criminals are taken to be tried. Similarly, people refer the Court to the Criminal Court. Perhaps, we do have Civil Court System. This means that initiating Or considering initiating court proceedings involves an automatic sense of being involved in wrongdoing and a fear that no one may somehow be punished. The Public has always bear in mind that "I have never had to go to court because I have done No wrong, Thankgoodness". Furtherance, people always question "Do you think you would get a fair hearing if you went to court?"... "Do you have confidence in our Court System?"as we are always told that there are many Corrupted Judges sitting on the bench despite enjoying their Judge's lives.

For God Sake, this is the negative perception of the Public on our Judicial System. However, in real world, Court is the right place where we can seek for Justice. Let say, the Government corrupts, the Rule makers worse, the only hope left to us is our Court. No matter what happens, Court should never fell in Darkness. Fairness would definitely be the Doctrine of which the Court should upholds until... No end... "I might sound biased to the Court?"

One more matter which I like to touch on which is the "hearing" of Court Case. Generally, Public has the sense that the proceedings of the Court are very interesting where they are Plantifs and Defendants arguing on behalf of their Clients. In some circumstances, I must agree with u that the Arguments do take place but believe me, Proceedings are never the same as we watch in TV & dramas. Speaking frankly, it is quite boring! This is what I could vomit out after I attended some hearings in Courts.

Hence, people shall understand despite knowing our Court more in detail. Perhaps, legal field people may liable to take up this responsiblity? We don't want people have the thoughts of which Court is only refer to Criminal Courts solely...

29th April, he is seem to be so concern of the PKFZ-Port Klang Free Zone scandal.
He then instructed PWC to release the audit to the public within 7 days.
A week after such instruction, He delayed the disclosure of the report on PKFZ.
Today, 21th May... He said he will leave it to the Cabinet to decide whether to reveal it to the public!!!...- It's UNBELIEVABLE!!!...

What is he doing? Being the President of MCA, the Minister of the Transport Ministry... His deed isn't what he says...

We want to know what is going on with the PKA. Why the costing of the Port Klang Free Zone transhipment hub project is ballooned from

RM1.8 billion in 2002 under the then Transport Minister, Datuk Seri Dr. Ling Liong Sik (with the Cabinet given the assurance that not a single sen of public funds would be needed as it was a viable and self-financing private project);

to more than double the original cost at RM4.6 billion under Datuk Seri Chan Kong Choy as Transport Minister; and

to the current frightening figure of RM12 billion under Ong.

There were so many questions in regards of this scandal!... One of them is the questions where there are some individuals had acquired the land where PKFZ sits now at RM 3 per sq ft in 1999 and the Port Klang Authority- PKA later acquired the land at RM 25 per sq ft.

Before, this scandal has already caused Tan Sri Chan Kong Choy dropped out from the 308 General Election and subsequently lost his job largely due to the way he handles PKFZ scandal.

I really don't understand what is so secretive about this audit?

Does this Scandal involve Barisan's leaders?

We have the right to know what is happening! This right shall not be deprived!... We want to know where has the billions of ringgit gone!!!...

Its good duly the Barisan Supreme Council's decision not to contest the Penanti by- election.

Obviously, we can adjudicate that this is only the manoeuvre being "played" by the Pakatan as to settle their inner problem, why shall Barisan mad together with them? Despite, Tun Dr Mahathir keeps presurring Najib not to give a free ride to Pakatan. In some circumstances, Barisan should contest as to show Barisan is able to fight whatsoever challenges. However, all aspects shall be taken into consideration. Playing Political Game isn't the right way to serve people. Though it is the process of practising the Doctrine Of Democracy but our nation's economy should be put at the very first place. The government especially the Barisan should focus most in boosting and restrengthing our economy. As what people say, "Prepare an umbrella before it rains". Restructure our economy, financial system as to assure that Malaysia's economy is secured!

We dare not and do not want something of which happened in US come to us. Since 2008 subprime mortgage crisis, The Biggest Bankruptcy ever filed in US history of which was the Lehman Brothers with its assets before bankruptcy was USD 690 billions follwed by Washington Mutual- 320 billions, and the lately bankruptcy suited by Chrysler- 39billions. Subsequently, the World Biggest Automaker, General Motors might be facing the same fate. How sorrow when our parents lose their jobs, how are them surviving?

Therefore, our brilliant government should take a good move as to ensure this is evitable.

Before I left my office yesterday, I got to speak with 1 of the staff who is the most "senior" in our legal firm... From our conversation, I find out that is not easy to own and operate a legal firm. U might be a very good lawyer as you are so skillful, so talented, so well in the knowledge of law. Whatever cases are on your fingertips, but let me tell you, this lawyer will end up with shutting down his law firm. You must be questioning why! This is simply because the weapon of surviving for a practice lawyer is his networking. Networking plays the role, networking adjudicate whether his/her firm is able to survive. Let face the facts, at Sentul itself, there are at least 50 legal firms of which are located around the area.

How do you compete with them?

For those who want to be practice lawyers, let's bear in mind that these are the problems which need to concern of.

I just finished giving tuition to some students... currently, I am a teacher of 2 primary students and 1 form 2 girl...

Dudes, it's not easy to be a teacher... especially a primary school teacher!!!...

11am, i reached my primary 5 student house, i started today class with mathematics as she is sitting for exam by this coming tuesday...

the syllabus is quite easy but it's the other way round in teaching and explaining such formulas...

e.g. 6574 + ? = 8574... this "?" can be found easily...

how a bout...

6574 + ? + ? = 8574

There are to many pairs of answers for these "?"...

hehe...the sad thing is my cute student did not understand as she thought the 2nd question also can be solved...

Sales and Purchase agreement....

Last friday,i was asked to handle a file in regards of selling a double storey house at petaling which worth RM 690k... I need to draft SPA, but before SPA, letter of consent has to be sent as to inform the land Office that we are selling a house and will transfer the owner of the such property to the purchaser from the vendor.

Besides LOConsent, an agreement of Confirmation Of Sales has to be signed by both Vendor and Purchaser...

Then???...

a land search will be conducted based on the Grant, this such search is vital to make sure there is no any caveat on the such land... Additionally, we are going to confirm the rightful vendor of the property than finally will come to the SPA...

basically, its about procedural matters... technicalities...

Therefore, we as the "solicitors"...hehe... have to make sure all these particulars have to be obeyed...

The 2 "P" namely POLITICIAN and POLICEMAN become crazy!!!!

In the morning, We are shocked for the chaos happened in Perak State Assembly sitting...
There were ADUN who climbed on the table of State Assembly hall. Do you think they are civilized???

At night, 5 lawyers were arrested by the policemen at Brickfield due to their representation for their clients who were detained for allegely participating a candlelight vigil for activist Wong Chin Huat...

Policemen do not know law???...i think i must ask them what is meant by "rule of law"...

It sounds so funny!!!... Doesn't it is clearly stated in art 5 (3) Federal Constitution which provided that the detained person shall be allowed to seek for their own lawyers???...
Besides, the 2nd "P" namely Policemen had violated specific provisions in the Criminal Procedure Code which guarantee the access to lawyers.

Please... What has happened to our lovely Malaysia???

2day is my first day doing attachment at LING YOKE HOOI & CO.
I was so nervous the time I stepped in the firm and my heart beeps faster when i was brought to a room next to the lawyer's room. However, i'm very satisfied, i was given my own office room,big table, aircond, computer...so well treat,
i thought i am going to do the office boy job like wash toilet,cut paper...but i was given some files,i started to draft letter today and 2mrw i will start draft sales and purchase agreement...2nite,i will do some studies on caveat in regards of land matters...the working environment is very good.
I will definitely love this job, though i travel 45 minutes from UKM every trip but i will make sure i contribute the best as i will appreciate my job!!!...

Thanks GOD, i believe this is a gift from GOD...

Since 308, there have been so many by- elections created by our Politician especially PR, before Penanti DUN settled, lately Manoharan, who is the ADUN Kota Alam Shah is seem like quitting his seat due to his detention under ISA and it will consequent to another by- election.
There’s enough!!!...
Are we going to see them spend millions again in these by- elections?
Dear Malaysians, why PR is keep creating by- elections???
What is the motive of DSAI???
Is DSAI trying to show PR is the more favorable one compare to BN???
Is DSAI fighting for our good???
Do you think he should put more concentrations to our economy???
Before these series of political scenario, I was so supportive to Pakatan, I feel that Malaysia should reform; we have to change the government, therefore Malaysians give Pakatan a chance. But, what they’ve done so far???

Although Malaysia is not directly affected by the US crisis but we do feel the heat. Due to this US crisis, Malaysia economy, especially the microchip industry is strongly affected. Based on Wall Street Journal, Malaysia is one of the biggest exporters in US. Sincerely, US is struggling in economy tsunami now, Obama’s administration has been trying so hard to rescue the Wall Street. Hundred billions of bail- out have been giving out yet so many Giant MNC such as General Motors is seem sinking to the ocean of Bankruptcy. Lehman Brothers has filed bankruptcy end of last year due to their subprime mortgage crisis, this coming June, we are going to see whether GM is filing bankruptcy as Chrysler has filed bankruptcy this month. These series of bankruptcy are not only due to profit- loss but also the confident- loss among the consumers. How it affects Malaysia?
Is very simple, US will reduce imports of Malaysian goods and this would gives an impact to our industry.
In 2009, Malaysia’s unemployment rate is increasing to 4.5%. Compare to 2008, 3.5%. Though is 1% different, but it signifies a lots. This is due to Malaysia is used to 2.5- 3%.
Hence, Malaysia’s politician should focus on our economy instead of playing political games.

Semester 2,bagi saya...amat pendek dan cepat berlalu, bagaikan sekelip mata sahaja. Kenang balik 28hb desember yang lepas, masa kami check in untuk semester 2, masuk kuliah seperti biasa, ade consti, contract, mls...

Perkara yang paling memeningkan adalah kita perlu belajar bahasa arab, " subahakhai...sabahannur...ismi...askunufi..."hahaha, walaubagaimanapun, bagi acap, haris subjek arab ni bagaikan kacang.

Namun, saya berasa amat gembira pada sem 2 ini, terasa best sangat. Yang hebat, kita dah de convention, convention ini bukan pasal sahaja minum dan cakap politik, malah cakap orang putih.
Banyak yang berlaku semester ini, ada yang pahit dan ada yang manis...

Teringat pada bulan lepas, kali pertama saya melangkah ke UiTM, masa itu adalah bersama acap, haris, bob, hassan dan syafiq sebab dengar hujah tv9 live.

Bulan- bulan yang lepas, kita berpeluang melihat live sidang parlimen...

Abng azim, abeh dan kak win datang bagi ceramah...

Program gaza... Dalam pada program ini, antara masa yang cukup gembira kerana dapat makan kek tiap- tiap hari. Orang ni takkan kita lupakan, siapakah dia??? Tak lain dan tak bukan, itulah Ara kita... Siapakah yang sanggup tidur pukul 3pagi hanya untuk buat muffin? Bukan senang nak buat muffin berpuluh- puluh ni.

Satu lagi yang kita takkan lupa ialah pbl kita...mls...consti...contract...

Dalam menyiapkan pbl mls, satu fuu bagaikan studio. Rakan- rakan yang bertegur akan bercakap pasal "shooting". Saya masih ingat lagi Acap cakap dengan saya, " are we lawyers? Everyone is concern about shooting"... Masing- masing kumpulan tutorial telah bekerja kuat dalam menghabiskaan tugasan ini, ada group yang buat shooting sampai ke POJ, kesemua group kita amat kreatif...

Walaupun ada segelintir yang menyifatkan shooting ini sebagai sesuatu yang membuang masa. Namun, bagi saya, cara pbl melalui shooting ini amat merelekskan, santai, menyeronokkan... Ia tidak terlalu teknikal seperti client counseling ataupun mooting.

Saya merasakan konsep "ying yang" sesuai menggambarkan situasi ini, di mana ada tugasan yang membebankan, pada masa yang sama, tidak kurang juga dengan sesuatu yang lebih ringan dan merelekskan. Konsep ini sangat penting dalam menyimbangkan kehidupan kita terutamanya dalam membahagikan tugasan seharian kita. Kata orang, seorang mesti rehat tak kira sesibuk manapun.
Banyak lagi yang kita lalui dalam semster 2 ini...

Kesemua yang kita lalui ini mendatangkan sesuatu kepada kita baik yang elok dan yang tak elok...

Thursday's nite, we had dinner at alamanda together with tutorial mates,but i brought along acap...bacause we planned to watch "fast and the furious 4" together.

It was raining during the time we left ukm,and we got caught in serious traffic congestion...

Along the way to alamanda, Acap keep saying,"bro,i'm fucking hungry." I was so hungry too...

After we had our meal,we went for 7.15 movie...

Fast and the furious was nice but not quiet nice...

We did not go back right after the movie but we went jalan- jalan, we turned around at the putrajaya mosque and we wanted to stop and take some fresh air at the nice bridge but we didn't because there was a police car parked right in front. then we left and we went to mamak at sg. long in front of utar.

During that time,i was so sleepy and wanted to go backe for rest earlier...

Acap saw i was so sleepy and we decided to move...

The story began...

On the way back...

At the speed of 95km/h...

My eyes closed,i fell asleep...

Luckily Acap saved us,but we clashed the car on the right side door...

Thank God for staying along with us...Thanks Acap so much,or else i can't imagine what would happen now....Lying on the bed at hospital???...who knows???....

It was just the matter of 10 seconds...if we miss it...accident!!!

Driving,really need full concentration...never fall sleep even a second...

When we reached ukm,we were blocked by pak guard...Haleez settled it...When Haleez was talking to pak guard,we stopped at the side...we then came out and have a look on the car, we decided not to tell the truth to bng bob because we were afraid of he will never borrow his car again...

However we were wrong...
I felt so uneasy after not telling the truth to bob...

Something came to my mind..." Why not u just tell bob the truth,tell him the whole story...let him understand...others can lie him but not u,he trusted u...let u drive his car...futhermore,u are convention gang..." i felt so regretful for not telling bob the truth...i can't sleep well,i can't really concentrate on my revision...may be it is the matter of friendship...Cheated our close friend is not easy.

I learnt it...

Saya berasa cukup gembira kerana ahsan betul- betul post kat blog pasal buruknya rokok. Ini adalah ekoran lunch ari Jumaat yang lepas di Ajura lama, sewaktu Bob p bayar, Ahsan ngan saya bincang nak buat something untuk stop-kan Mr. Bob dan Acap enti isap, kami pun bersetuju akan post-kan kat blog..."hahahaha"...Thanks Ahsan!

2apr, tutorial 'islamic legal system' berlangsung...terdapat satu kumpulan yang membuat perbentangan, rakan yang duduk bersebelahah- bob, bertanyakan kenapa orang cina payah untuk sebut sesetengah perkataan melayu. Semasa perbentangan, seorang pembentang tersebut "teribat", "sivir" sedangakan ia sepatutnya disebut sebagai "terlibat" dan "sivil".
Wahai rakan- rakan saya, saya berasa amat malu, sedih. Seringkali, orang cina disanjung disebabkan kemahirannya dan kehebatannya dalam aspek ekonomi, namun apabila bercakapkan penguasaan bahasa, kaum cina jauh ditiggalkan. Bahasa yang saya maksudkan ialah bahasa melayu. Lazimnya, orang cina kurang mahir dalam bahasa melayu, pertuturan kurang fasih dan permahaman yang lemah. Ini menjadikan orang cina serigkali dipandang rendah dalam aspek penguasaan bahasa melayu. Kita tengoklah kawan di sekeliling kita, ramaikah yang mampu bertutur bm dengan fasih lancar. Jangan salah faham, saya tidak bermaksud semua cina tidak boleh bertutur dengan baik, tidak dinafikan ada juga yang fasih dan lancar dia bercakap.
Mungkin benda ini kami tidak pandang berat, ada pula orang kata "wat pe nak hebat sangat,leh faham...leh jawab...dah la to. Cakap sehebat mana pon tak jadi kaya...". Namun, ia cukup berbeza bagi saya, saya merasakan wujudnya satu keperluan untuk kami kuasai bahasa melayu. Kata orang, kalau nak orang hormat hang, hang kene hebat dulu.
Terlebih dahulu, saya ingin suarakan perspektif saya mengenai bahasa melayu. Saya merasakan penguasaan bahasa orang lain menjadikan kami lebih matang, lebih berilmu, lebih mantap. Contohnya, kami pelajari bahasa melayu, kami bukan sahaja belajar tatabahasanya, ejaannya...tapi, kami berpeluang mengambil tahu tentang budaya orang melayu, masakan dan makan orang melayu dan banyak lagi. Pada masa yang sama, kami dapat membandingkan perbezaan kaum cina dan melayu dalam banyak aspek. Maka, saya berasa bangga sekali kerana saya dapat, berpeluang belajar bahasa melayu. Kembali ke zaman persekolahan, saya boleh digolongkan dalam puak- puak yang anti malay bukan sahaja dari segi bahasanya, malah orang melayu saya anti-kan. Sikap ini berterusan sehinggalah zaman sekolah menengah, semasa di tingkatan dua saya mengambil bahagian dalam debat...huiyo, hebatnya...debat...hahahaha...buat pertama kali saya melangkah ke sekolah kebangsaan, sekolah yang dijajah oleh orang melayu, satupun orang cina saya tak nampak. Okaylah, relek je...bisik i dalam hati, " i datang pun bukan nak mengorat tapi debat". Sewaktu debat berlangsung, kami- satu- satunya sekolah yang menghantar semua pendebat kaum cina. Kamu nak tahu apa yang berlaku? Kami bertiga kaku semasa debat, mulut seolah- olah tersumbat, perkataan susah sekali hendak di lontarkan dari mulut. Wahai rakanku, cuba bayangkan, dengan satu dewan penuh penonton, saya, dengan pakaian yang cukup segak, rambut bersinar, kasut lagilah shining...tersekat- sekat menyampaikan hujah. Analoginya, sebuah Ferrari yang tidak boleh lari...Hancur semua pakaian segak, rambut dan kasutku...
Bermulalah saat itu, saya telah berjanji dengan diri sendiri untuk majukan bahasa melayu. Saya berkata kepada kawan saya, saya mesti kuasai, mahir dan hebat dalam bahasa melayu. Bagi saya, mengapa kami tidak belajar sungguh- sungguh apabila kami diberi peluang...
bangkitlah wahai rakan- rakan saya...kuasailah bahasa malayu...
Jangan sesekali meminggirkan dan menolak bahasa melayu...
Kita hidup di Malaysia...
kita rakyat Malaysia...
Biarlah hebat dalam ekonomi mahupun bahasa melayu!!!

Come on malaysians, let us put our hands together, let's welcome the new coming PM- Najib Tun Razak...at the meantime, let us thank Pak Lah for leading our nation to the another "level".

RAKYAT are not blind,

RAKYAT are not stupid...

we have ears,

All of us know what Dolah has brought to our country, he “developed” Malaysia so much...there is less than 24 hours and it comes to the end of Malaysia's 5th premier. He might feel tired, boring and so on. Today, he left RAKYAT with some batiks besides JAC and MACC...However, we should thank him. We never compare Dolah with Dr. M, its like comparing a Rolls Royce and a Proton.

3rd March 2009, Najib will be swearing in as Malaysia's 6th premier. He is going to take over a country flooded with problems...economic crisis, 4.5% unemployment, politic crisis and many more.

RAKYAT are going to see how he, muhidin and the team reform Malaysia. Malaysia must change, for the very first place system should reform...a radical reform...a thunderous change...We don't want our country far left behind,they shall not disappoint RAKYAT,they should have valued...treasured...cherished the mandate given by RAKYAT. We expect many from Najib, we will judge every single steps he walks.

We give him a chance to change!!!

we, as an observer who observe them steadily...we know how capable they are!...there are some people saying that there will be changes in Malaysia after transition power by 3rd of April...The innocent nation expect clean government, transparent government...many we have expected,before Najib- altantuya take over from Dollah,something silly and unbelievable happened.How come a guy who commited and was warned can win the UMNO youth???That's really sad,hopeless for UMNO...Just wait and see,is Najib our miracle???can he changes Malaysia???

I finally believe Malaysia Boleh...Malaysia is a country whatever BOLEH settle with $$$$$...

PPSMI helps improve English among students...

We want others to respect us, accept Malay, we need to improve and develop in all expects especially science and technology; we should accept the reality that English is a tool which can help Malaysia to compete in international level.

Malaysian scientists or experts who represent Malaysia in international conference, can they deliver their messages effectively in Malay? I am not looking down our national language but we have to be realistic, we cannot survive beyond the reality.

A language of a nation will only be learned and accepted by other countries if only we are truly developed and we are famous in doing some researches which knowledge and technique solely belongs to our nation.

For instance, the Europeans have to learn Arabic language because the Islamic Civilization was once being respected. However, when the Muslim ignored or overlooked science, medical knowledge, the Europeans started not to learn Arabic language and later, we have to learn and understand English.

PPSMI is a basic tool which helps students to understand better and easier in science and mathematics information. At the meantime, we cannot deny that if this policy is being implemented among students, indirectly it will improve the standard of English among the students as in order to answer and pass the exam, whether they like it they have to find ways to understand the textbooks.

You might be questioning me it may worsen the situation as students cannot understand their textbook, how are they going to score. Actually, nothing is easy in this world we have to open up our mind consider about log term effect. It’s true we might not be seeing its good effect when students in primary but they will feel its advantages when they step into secondary. PPSMI acts as a tool to polish up the students starting primary and provides them an easier pathway in learning and understanding science and mathematics knowledge.

Just question ourselves, why we study science and mathematics. We want to develop our nation, our country, we want others to respect us, learn our national language in order to learn and obtain our knowledge.

PPSMI is the outcome of a policy decision made by the Government of Malaysia as the result from the Minister’s Council Meeting held on 19 July 2002.The implementation of PPSMI was carried out in stages beginning with the 2003 schooling session. The pioneers were all Year 1 students for Primary Schools, Form 1 and Lower 6 students for Secondary Schools.The full implementation of PPSMI was in 2007 for Secondary Schools and 2008 for Primary Schools.The rationale for the decision to change the medium of instruction from the Malay Language to English for the teaching and learning of Science and Mathematics subjects was made based on the government’s concern on the nation’s human capital development towards achieving the standard of a developed country, as well as an early preparation to compete in the era of globalization.It is widely known that the field of science and mathematics form the basis and have a crucial role in the progress and development of a country. Various innovations and discoveries in these two fields happen rapidly and information access is mostly in the English language.English language is also the language spoken internationally and mastery in this language would allow easy access to information in these fields.In conclusion, the policy decision to implement PPSMI was made to ensure students’ mastery in science and mathematics in view of the fact that most of the sources are available in the English language. Indirectly, it is also hoped that the implementation of PPSMI would contribute to the enhancing of students’ command of the language.- MINISTRY OF EDUCATION
